**General Terms and Conditions (GTC)** for the Rental of a Holiday Apartment in Würzburg (City Center)

1. Scope of Application** These General Terms and Conditions apply to the temporary rental of the holiday apartment to guests as well as all related services provided by the host. Deviating terms and conditions of the guest do not apply.

2. Booking & Conclusion of Contract** The rental agreement becomes binding upon the booking confirmation sent by email. By completing the booking, the guest accepts these GTC.

3. Payment** Unless otherwise agreed, the total amount of the booking is due at the time of booking.

4. Cancellation** Cancellations must be submitted in writing by email or via the respective booking platforms. The following cancellation conditions apply unless other arrangements have been agreed: * Up to 5 days before arrival: free of charge * Within 5 days before arrival: 100% of the total price Saved expenses will be credited; successful re-rental will also be taken into account.

5. Arrival & Departure** * **Check-in:** from 4:00 p.m. on the day of arrival * **Check-out:** by 11:00 a.m. on the day of departure A late check-out is only possible by prior arrangement. Access is provided via a digital access system (Bold app) or a lock box. A personal handover may be possible depending on availability.

6. Use of the Holiday Apartment** The guest agrees to treat the apartment with care, report damages immediately, allow only the stated number of guests to stay, comply with the house rules, refrain from hosting parties/bachelor or bachelorette events, not transfer the apartment to third parties, and not use the apartment for any purpose other than typical holiday accommodation.

7. Access to the Apartment by the Host** The host may enter the apartment only after prior notice and with a legitimate reason (e.g., danger prevention, emergency, necessary repairs, technical malfunctions). In cases of immediate danger, access is permitted without prior notice.

8. Damages & Liability** The guest is liable for damages caused by themselves or accompanying persons. The host is liable only for damages caused intentionally or through gross negligence. Liability for damages to life, body, or health remains unaffected.

9. Cleaning** Final cleaning is included in the rental price; however, the apartment must be left in a swept-clean condition. The guest must: * dispose of waste, * wash and store dishes and kitchen utensils, * close windows, * switch off lights, * set the heating to level 2. Excessive dirt will be charged according to the additional cleaning effort.

10. Pets** Pets are not permitted.

11. Smoking** Smoking is prohibited inside the apartment; it is allowed only outside (including the garage). In case of violations, an additional cleaning fee will be charged.

12. Wi-Fi Usage** Wi-Fi is provided free of charge. The guest agrees not to download or distribute unlawful content and not to share login details with third parties. In case of violations, the guest is liable.

13. House Rules** The house rules form part of these GTC.

14. Force Majeure** In cases of true force majeure (natural disasters, official usage bans, or events beyond the host’s control), the host may withdraw from the contract. This does not apply to technical defects or structural issues.

15. Data Protection** Personal data is processed exclusively for contract fulfillment and in accordance with the GDPR.

16. Special Agreement** A passageway of at least 1.50 m must be kept clear at all times in the garage to ensure barrier-free access to the neurological practice located on the premises. Guests are informed of this prior to booking.

17. Applicable Law & Place of Jurisdiction** German law applies. For claims brought by the guest, the statutory places of jurisdiction apply.
